Copyright violations?

Upon posting my video to YouTube and Facebook (or at least attempting to) I notice that my video got flagged for "restricted content" or something like that on YouTube, and the video won't play on iPhones.  When I tried to upload to Facebook, I got a notice saying my video was a copyright violation and the video did not upload *at all*.

I didn't have this problem at Halloween, but the music I used was not as easily identifiable.

BTW, I did legitimately *purchase* all of the music I have used in sequences so far, from iTunes and then converted to MP3 format using Audacity.  The song I used for Christmas (Linus & Lucy from Charlie Brown Christmas) is probably one of the easier ones to recognize, but other than that I don't know why this is happening.

Has anyone else had issues like this?  Obviously they are making the software smarter these days!  If this is taken to its logical conclusion, we will either have to pay royalties or simply not be able to use copyrighted music in our uploads.  I do know from past experience that what we are doing is legally considered a "public performance".  Pretty stupid considering we're not making a dime, though I guess some people do monetize their videos if they have something that can get high hit counts.

One thing that did just occur to me.  For Halloween, I just used the audio from the camcorder recording, which of course had some background noise, etc.  This time I superimposed the original song over the video in my movie editor, so the sound was clean and unaltered.

I'll bet if I post it the 'low quality' way I won't have the same issue.  I'll try it and report back.

This is a known thing,

While you have the right to listen to the music you purchased you don't have the right to broadcast it.

This comes up every year.

The detection/identification software is getting better, so fewer songs fall through the cracks.
Some publishers allow their songs to be reposted, others do not.
vimeo used to check for copyright violations less thoroughly, but now they are closer to youtube.

you can ask for them to reevaluate through a contest form, and that might allow you to repost.

One would think once it flags the song, it would automatically throw up an ad, and put a purchase in itunes link to the song and then send all money earned to the rightful owner of the content. When I film my lights the audio is from the speakers in my truck captured on the iPhone so the quality is crap. If people like the song they won't be ripping the audio from my video, they will be clicking the purchase button and everyone wins.


If I have to remove my videos I will, but I too got the notice on all 5 of my videos posted. Waiting for the IP lawyers to knock on my door or serve me a note. Hope it doesn't get flagged as spam from the intelligent tools that youtube/ google deploy.

I have been using Vimeo with no issues at this time, but I also know when it comes to Youtube people are using this method to get by the issue. All I am doing is passing on information here

1) Go to "My Videos".
2) Select "Resolve Copyright" on the video you are having copyright issues with. OR, go to the video itself and choose "resolve copyright" from there.
3) Scroll down and pick the option "I want to learn more about this dispute process".
4) Scroll down and pick the option "Take me to the dispute form".
5) Pick option #2 and PASTE the following statement into the text bar next to it;

"Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use."

6) Fill out the rest of the info on the page. Use your REAL name where it asks for it. Choose "Continue" when all information has been filled out.
7) Scroll down on the next page and select "Submit dispute".

Within 2-3 minutes your video's audio should be back!

Occasionally this will not work. Like I said in the video, this copyright covers 99% of copyrighted entertainment (From what I found out at least). Also, this will ONLY apply if you are not making any profit off your videos. If you intend to become a youtube partner, I would not suggest doing this.
